Terms and Conditions – K-pop Webshop

Article 1 – Definitions

In these terms and conditions the following terms shall have the following meanings:
K-pop WebshopThe company, based in Delden, registered with the Dutch Chamber of Commerce under number 98506196 and with VAT number NL001853018B24, hereinafter referred to as: seller.
Buyer: any natural person or legal entity that places an order via the webshop.
Agreement: any mutual agreement between seller and buyer regarding the purchase and delivery of products.
Products: all items offered through the webshop.

Article 2 – Applicability

These general terms and conditions apply to every offer from K-pop Webshop and to every agreement concluded between buyer and seller.
Deviations from these conditions can only be agreed in writing.

Article 3 – Orders and payments

Orders placed via the webshop must be paid in full in advance.
If payment is not received or not received on time, the seller has the right to suspend or cancel the order. Any additional costs resulting from collection will be borne by the buyer.
In the event of bankruptcy or suspension of payments by the buyer, all outstanding amounts are immediately due and payable.

Article 4 – Prices and offers

All prices on the website include VAT and other statutory charges.
Offers are valid while supplies last or within the stated period.
Price changes are subject to change at any time. Obvious pricing errors are not binding on the seller.

Article 5 – Reflection period and returns

Consumers have the right to 14 days to cancel the purchase without giving any reason after receiving their order.
The right of withdrawal is excluded for:

CDs, DVDs or other sealed products where the seal has been broken.
When exercising your right of withdrawal, the product must be returned unused, undamaged and, if possible, in its original packaging.
Returns can be registered by email or using a returns form that will be sent on request.

Article 6 – Amendment of the agreement

If during the processing of an order it appears that adjustments are necessary, the buyer and seller will consult with each other to adjust the agreement.
Any consequences for price or delivery time will be discussed in advance. Adjustments made by the seller do not entitle the buyer to additional costs.

Article 7 – Transfer of Risk

Once the product is received by the buyer, the risk of loss or damage passes to the buyer.

Article 8 – Inspection and complaints

After receiving the product, the buyer must check whether it meets expectations.
Complaints about damage or deviations must be submitted within 10 working days must be reported in writing upon receipt.
In the event of justified complaints, the seller will offer an appropriate solution, such as repair, replacement or (partial) refund.

Article 9 – Delivery

The products will be delivered to the address specified by the buyer.
Any shipping costs will be clearly stated when completing the order.
Seller is not liable for delays beyond its control, such as those caused by the delivery service.
The delivery time is indicative and exceeding it does not automatically entitle you to compensation or cancellation.

Article 10 – Force Majeure

In the event of circumstances beyond the seller's control (such as strikes, transport problems, natural disasters or disruptions at suppliers), force majeure exists.
In that case, obligations are suspended. If the situation persists for more than 30 days, the agreement can be terminated in writing.

Article 11 – Retention of title

The delivered products remain the property of K-pop Webshop until full payment has been received.
Until then, the items may not be resold, pledged or otherwise disposed of.

Article 12 – Liability

K-pop Webshop is not liable for damage resulting from incorrect use of the product.
If K-pop Webshop is held liable, this is limited to the amount paid out through the liability insurance.
Damage resulting from intent or gross negligence by the seller is excluded.

Article 13 – Warranty

The products supplied by K-pop Webshop have a 2-year warranty, unless otherwise stated.
The warranty is void in the event of damage caused by improper use, modifications to the product, or use for purposes other than those for which it is intended.
For items covered by the manufacturer's warranty, the terms and conditions of the respective manufacturer apply.

Article 14 – Complaints procedure

Complaints can be submitted via email or contact form. We aim to respond within 5 business days.
If the complaint is justified, a suitable solution will be sought together with the buyer.

Article 15 – Applicable law and disputes

Dutch law applies to all agreements.
Any disputes shall be submitted to the competent court in Almelo.
The applicability of the Vienna Sales Convention is excluded.
